How Is Delta 9 THC Legal?

The 2018 Farm Bill
The 2018 Farm Bill authorized the widespread production and commercialization of hemp derived products (including CBD oils, compliant THC gummies, and other products) on a federal level, and removed hemp from the DEA (Drug Enforcement Administration) list of Controlled Substances.
This Bill differentiated industrial hemp from marijuana, which is cultivated for its high THC content. Federally legal hemp products, according to the Farm Bill, must contain less than 0.3% of THC on a dry weight basis, and the source of THC must be industrial hemp.
Even though hemp is legal on a federal level, each state can determine which hemp-derived products are legal in said state. For example, Delta 8 gummies are legal on a federal level but illegal in a number of states.

The Utah Department of Agriculture established Administrative Rule 68-24 for the purpose of regulation, licensure, and enforcement of the cultivation and production of industrial hemp in 2019 when Governor Gary Herbert signed the Utah Hemp and Cannabinoid Act (4-41) into law.

Governor Herbert signed additional modifications to the Act into law on September 23, 2019, making substantial changes to the state's regulatory framework. Among the changes are the elimination of the proposed state central fill pharmacy in favor of issuing more licenses to private pharmacies for the distribution of medical cannabis, the creation of an online state central patient portal for electronic access to home deliveries of medical cannabis shipments, the provision of electronic medical cannabis cards, the establishment of licenses for research universities to conduct academic medical cannabis research, and changes to the regulatory framework.
According to Utah state regulations:
- Patients possession limits: medical cannabis products may be dispensed as “tablets,” “capsules,” “concentrated oils,” “topical preparations,” “transdermal preparations,” “sublingual preparations,” or in a” a liquid suspension,” or as a “a gelatinous cube or lozenge.” State-mandated “legal dosage limit” for medical cannabis products that shall not exceed 20 grams of THC per single dose. Raw cannabis” must be dispensed in a “tamper-resistant” sealed container with a 60-day expiration date. Patients may obtain up to a 30-day supply of medical cannabis products. A 30-day supply of “unprocessed cannabis” should not exceed 113 grams by weight.
- Home cultivation: replacement legislation approved by the House and Senate rewrote the Utah Medical Cannabis Act to eliminate any home cultivation option. Proponents of the voter-initiated measure are suing over the changes.
- Caregivers: patients may designate no more than two caregivers, who may purchase, transport, or assist the patient in his/her use of medical cannabis in a dosage form.

Hemp Farming Act
Sec. 1 Definitions—Industrial Hemp
The following words and terms shall have the following meanings:
Acceptable Industrial Hemp THC Level- a total composite tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis if laboratory testing confirms a result within a measurement of uncertainty that includes the total composite tetrahydrocannabinol concentration of 0.3 percent.
Cannabis-all parts of the cannabis plant, whether growing or not, including its seeds, resin, compounds, salts, derivatives, and extracts.
CBD-cannabidiol.
Industrial Hemp-the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a THC concentration of not more than 0.3 percent on a dry weight basis.
Industrial Hemp Plant Parts-any floral buds, leaves, roots, seeds, stalks, or stems of the plant Cannabis sativa L. with a THC concentration of not more than 0.3 percent on a dry weight basis.
Industrial Hemp Products-products derived from, or made by, processing industrial hemp plants or plant parts.
