In November 2019, Governor Tony Evers signed Senate Bill 188 commonly referred to as the 2019 Wisconsin Act 68 into law which legalized the growth, production, and transportation of industrial hemp in the state. The bill brought Wisconsin's hemp program in line with federal law as part of the 2018 Farm Bill.

The Wisconsin Act 68 removes hemp from the definition of marijuana and from the list of illegal drugs under the Controlled Substances Act. The act makes it lawful to cultivate, produce, and sell hemp and related goods.

The Wisconsin Act 68 also provided:

  • Wisconsin Department of Agriculture, Trade, and Consumer Protection (DATCP) the authority to issue licenses for planting, growing, cultivating, harvesting, producing, sampling, testing, processing, transporting, transferring, taking possession of, selling, importing and exporting hemp;
  • DATCP the authority to identify the requirements for applying for a license, approve or deny a license, suspend or revoke a license, and set fees associated with licensing, set criteria for approving persons to undertake any sampling and testing of hemp, release personally identifiable information to law enforcement if the licensee elects.

Medical Marijuana in Wisconsin

In this section, “ hemp” means the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9-tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis or the maximum concentration allowed under federal law up to 1 percent, whichever is greater, as tested using post-decarboxylation or other similarly reliable methods. “Hemp” does not include a prescription drug product that has been approved by the U.S. food and drug administration.

(2) Regulation of hemp.

(a) Subject to the provisions under this section, a person may plant, grow, cultivate, harvest, produce, sample, test, process, transport, transfer, take possession of, sell, import, and export hemp in this state to the greatest extent allowed under federal law.
