In 2018, Delaware received approval from the U.S. Department of Agriculture (USDA) to implement its state hemp program. With this approval, Delaware joins the majority of states that have adopted Farm Bill guidelines for hemp and hemp-derived products.

Per the 2018 Farm Bill, on a Federal level Delta 9 THC products are legal in the United States, so long as they meet the following two conditions.

Following the federal legalization of hemp for industrial purposes, Delaware followed up with similar state legislation authorizing the commercialization of Delta 9 THC products.The Delaware Senate Bill 266 was signed into law in 2018, which authorized the Delaware Department of Agriculture to administer a state hemp program and accordingly legalize industrial hemp in consumer products, as well as its large-scale growing and production.

The 2018 Farm Bill

The 2018 Farm Bill authorized the widespread production and commercialization of hemp derived products (including CBD oils, compliant THC gummies, and other products) on a federal level, and removed hemp from the DEA (Drug Enforcement Administration) list of Controlled Substances.

This Bill differentiated industrial hemp from marijuana, which is cultivated for its high THC content. Federally legal hemp products, according to the Farm Bill, must contain less than 0.3% of THC on a dry weight basis, and the source of THC must be industrial hemp.

Even though hemp is legal on a federal level, each state can determine which hemp-derived products are legal in said state. For example, Delta 8 gummies are legal on a federal level but illegal in a number of states.

 

The 2018 Farm Bill gives states the authority to submit plans to the United States Secretary of Agriculture in order to have primary regulatory control over the production of hemp within their borders. The plans must include procedures for tracking the land on which hemp will be grown, as well as testing, disposal, enforcement, inspection, and certification procedures.

Delaware Senate Bill 266

Following the Agricultural Act of 2018 ("2018 Farm Bill"), which legalized CBD and hemp production nationally by removing hemp and its derivatives (Cannabis sativa-L containing no more than 0.3% THC) from the Controlled Substances Act, Delaware chose to legalize the production and sale of certain hemp-derived THC and CBD products.

In August, 2018, Governor John Carney signed Senate Bill 266 into law. SB 266 allowed for hemp cultivation for agricultural or academic research, which was the only way hemp could be produced in Delaware in 2019. The bill brought Delaware's hemp program in line with federal law as part of the 2018 Farm Bill.

Senate Bill 266 also authorized the Delaware Department of Agriculture to enact any policies and regulations required to cultivate hemp when federal law approved production of hemp for purposes other than agricultural or academic research.

The USDA authorized the State of Delaware Plan for a Domestic Hemp Production Program on January 27, 2020.

Senate Bill 266 requires hemp growers and processors to apply to the state Department of Agriculture for a license.

Medical Marijuana in Delaware

The term “medical marijuana” refers to using the whole unprocessed marijuana plant or its basic extracts to treat a disease or symptom. Studies show that the marijuana plant contains chemicals that may help treat a range of illnesses or symptoms, and can assist patients suffering from serious medical conditions by alleviating pain and improving their quality of life.

While some states have already legalized marijuana for medicinal purposes, the issue is still being hotly debated in many others. As of 2019, a total of 41 states in the US have successfully legislated medical marijuana programs, with 19 states adopting recreational cannabis programs, and 23 states decriminalizing all forms of cannabis entirely.

In May 2011, Governor Jack Markell signed the Delaware Medical Marijuana Code allowing patients 18 and older with "certain serious or debilitating conditions" to use cannabis, and possess up to six ounces. In addition to having a qualifying condition, patients must obtain a medical card, and the card must be renewed once a year.

Patients are not allowed to grow their own cannabis, but they may possess up to six ounces of marijuana. Delaware medical marijuana program includes tightly regulated, limited distribution of medical cannabis by not-for-profit compassion centers. Currently, six compassion centers are operating in the state.

According to Delaware state regulations:

  • Patient possession limits: six ounces.
  • Caregivers: all caregivers must submit the proper required documentation to the State Department of Health.

Sec.1 Definitions—Industrial Hemp vs Marijuana

(2) “Industrial hemp” means the plant Cannabis sativa L.and any part of such plant, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis.

(19) Any material, compound, combination, mixture, synthetic substitute or preparation which contains any quantity of marijuana or any tetrahydrocannabinols, their salts, isomers or salts of isomers and is not approved for use by the US Food and Drug Administration;

(d) Any material, compound, mixture or preparation which contains any quantity of the following hallucinogenic substances, their salts, isomers and salts of isomers, unless specifically excepted, whenever the existence of these salts, isomers, and salts of isomers is possible within the specific chemical designation.

(28) “Marijuana” means all parts of the plant Cannabis sativa L., whether growing or not, the seeds thereof, the resin extracted from any part of the plant, and every compound, manufacture, salt, derivative, mixture, or preparation of the plant, its seeds or resin. It does not include the mature stalks of the plant, fiber produced from the stalks, oil or cake made from the seeds of the plant, or any other compound, manufacture, salt, derivative, mixture or preparation of the mature stalks (except the resin extracted therefrom), fiber, oil or cake, or the sterilized seed of the plant which is incapable of germination. Marijuana does not include products approved by the US Food and Drug Administration.

In other words, similar to the Farm Bill specifications, Delta 9 THC products can be sold in Delaware if they meet the following criteria:

  2. The product contains 0.3% or less of THC by dry weight
