  2. Products contain 0.3% or less of THC by dry weight

Iowa followed up with similar state legislation authorizing the use of Delta 9 THC products that meet Farm Bill criteria. While Delta 9 is legal in Iowa when certain conditions are met, Iowa is one of the few states in America that has banned Delta 8 THC.

The 2018 Farm Bill

The 2018 Farm Bill authorized the widespread production of hemp derived products on a federal level, and removed hemp from the DEA (Drug Enforcement Administration) list of Controlled Substances.

This Bill differentiated industrial hemp from marijuana, which is cultivated for its high THC content. Federally legal hemp products, according to the Farm Bill, must contain less than 0.3% of THC by dry weight, and the source of THC must be industrial hemp.

Even though hemp is legal on a federal level, each state can determine which hemp-derived products are legal in said state. For example, Delta 8 THC gummies are legal on a federal level but illegal in a number of states.

The 2018 Farm Bill gives states the authority to submit plans to the United States Secretary of Agriculture in order to have primary regulatory control over the production of hemp within their borders. Iowa Senate File 2398

Soon after the US Federal government passed the Farm Bill in 2018, on March 14, 2019, the Senate approved Senate File 2398, also known as the Iowa Industrial Hemp Act. The bill allows for the cultivation and processing of industrial hemp in the state of Iowa.

 

Senate File 2398 was amended by the Iowa Senate to include provisions for testing industrial hemp plants to ensure that they do not exceed allowable THC levels. In addition, the Senate File 2398 specifies that industrial hemp may not be used to produce medical cannabidiol, a cannabis compound with medical benefits.

 

Senate File 2398 created two state initiatives: the Industrial Hemp Commodity Program, administered by the Iowa Department of Agriculture and Land Stewardship, and the Industrial Hemp Production Program, administered by a Board of Regents institution.

 

On May 13, 2019, Governor Kim Reynolds signed Iowa Senate File 599 into law, which began the process to allow for the industrial production of hemp within the State of Iowa.

 

In 2020, Iowa received approval from the U.S. Department of Agriculture (USDA) to implement its state hemp program. The USDA has approved the state's proposed regulatory plan, clearing the way for an individual farmer to grow up to 40 acres of hemp with THC levels of 0.3% or less, according to the Iowa Department of Agriculture.

Medical Marijuana in Iowa

 

Medical marijuana is technically permitted in Iowa, but legalization is mixed. Preparations such as capsules, tinctures, and lotions are legal, but smokable medical marijuana is not.

 

Iowa has one of the strictest CBD laws. They require that consumers register for a medical CBD card and purchase CBD at registered dispensaries.

 

Iowa's Medical Cannabidiol Program is one of the most regulated medical cannabis programs, allowing only cannabis preparations rather than the raw flower. Only two manufacturers are approved in the state, home growing is not permitted, and patients are limited to 90 days of THC access unless they have a waiver.

 

According to Iowa state regulations:

  • In order to enroll in the program, patients must obtain a written certification from their primary care provider, who must be either a doctor, a podiatrist, or a physician's assistant. Patients must be permanent residents of Iowa state. Patients under 18 can only enroll in the program through their caregivers.
  • Card fees for patients are $100. However, if the patient receives social security disability benefits, supplemental security insurance payments, or is enrolled in a medical assistance program, the fee is $25. Caregiver cards are $25.

 

The use of recreational marijuana in Iowa is still illegal.

 

Section. 2 NEW SECTION

188.1 This chapter shall be known and may be cited as the “Iowa 10 Industrial Hemp Act”.

 

188.2 Definitions.

 

  1. “Industrial hemp” means any part of the Cannabis sativa plant, whether growing or not, with a concentration of delta-9 tetrahydrocannabinol that does not exceed the maximum concentration for the plant as determined pursuant to section 188.8.
  2. “Industrial hemp plant” means all non-seed parts of industrial hemp, whether growing or not.
  3. a. “Industrial hemp product” means any item manufactured from industrial hemp, including but not limited to cloth, cordage, fiber, food, fuel, paint, paper, particleboard, plastic, industrial hemp seed, seed meal, or seed oil.

 

  1. “Licensee” means a hemp manufacturer who obtains a license from the department under section 188.15 to participate in the industrial hemp commodity program established pursuant to section 188.13 or the industrial hemp production program established pursuant to section 188.14.

 

  1. “Production” means any part of planting, cultivating, or harvesting industrial hemp.

 

Sec. 7. NEW SECTION.

188.6 General prohibitions.

 

  1. A person shall not produce, handle, transport, market, or process industrial hemp in this state unless the industrial hemp has been produced pursuant to the industrial hemp commodity program established pursuant to section 188.13 or the industrial hemp production program established pursuant to section 188.14.

 

  1. Nothing in this chapter prevents a person from producing, handling, transporting, marketing, or processing an industrial hemp product.

 

Sec. 8. NEW SECTION.

188.7 Cannabidiol production prohibited —— contingent repeal.

 

  1. Industrial hemp shall not be used to produce medical cannabidiol as defined in section 124E.2.

 

  1. Nothing in this chapter shall be construed to authorize a person to recommend, possess, use, dispense, deliver, transport, or administer medical cannabidiol.
