How Is Delta 9 THC Legal?

Following the federal legalization of hemp for industrial purposes, North Dakota followed up with similar state legislation authorizing the commercialization of Delta 9 THC products.The North Dakota House Bill 1349 was signed into law in 2019, which authorized the North Dakota Department of Agriculture to administer a state hemp program and accordingly legalize industrial hemp in consumer products, as well as its large-scale growing and production.

The 2018 Farm Bill

The 2018 Farm Bill authorized the widespread production and commercialization of hemp derived products (including CBD oils, compliant THC gummies, and other products) on a federal level, and removed hemp from the DEA (Drug Enforcement Administration) list of Controlled Substances.

This Bill differentiated industrial hemp from marijuana, which is cultivated for its high THC content. Federally legal hemp products, according to the Farm Bill, must contain less than 0.3% of THC on a dry weight basis, and the source of THC must be industrial hemp.

Even though hemp is legal on a federal level, each state can determine which hemp-derived products are legal in said state. For example, Delta 8 gummies are legal on a federal level but illegal in a number of states.


The 2018 Farm Bill gives states the authority to submit plans to the United States Secretary of Agriculture in order to have primary regulatory control over the production of hemp within their borders. The plans must include procedures for tracking the land on which hemp will be grown, as well as testing, disposal, enforcement, inspection, and certification procedures.

North Dakota House Bill 1349

Following the Agricultural Act of 2018 ("2018 Farm Bill"), which legalized CBD and hemp production nationally by removing hemp and its derivatives (Cannabis sativa-L containing no more than 0.3% THC) from the Controlled Substances Act, North Dakota chose to legalize the production and sale of certain hemp-derived THC and CBD products.

In March, 2019, Governor Doug Burgum signed House Bill 1349 into law which legalized the growth, production, and transportation of industrial hemp in the state. The bill brought North Dakota's hemp program in line with federal law as part of the 2018 Farm Bill.

House Bill 1349 requires hemp growers and processors to apply to the state Department of Agriculture for a license.

Medical Marijuana in North Dakota

The term “medical marijuana” refers to using the whole unprocessed marijuana plant or its basic extracts to treat a disease or symptom. Measure 5, also known as the North Dakota Compassionate Care Act, was enacted by voters in 2016. In 2017, both houses of the North Dakota legislature passed State Bill 2344 (SB 2344), which amended the medical cannabis statute by deleting a provision that permitted medical marijuana patients to cultivate their own marijuana.

North Dakota legalized medical marijuana in 2017. The North Dakota Department of Health designed and implemented a medical marijuana program allowing qualifying patients and caregivers to produce, process, sell, dispense, and use marijuana for medicinal purposes. Pure Dakota LLC and Grassroots Cannabis were chosen in May 2018 to manage the two production facilities permitted under the program's guidelines.

According to North Dakota state regulations:

  • Patient possession limits: Patients who possess a physician’s recommendation may legally obtain up to three ounces of herbal medical cannabis provided by state licensed dispensaries. A registered qualifying patient may not purchase or have purchased by a registered designated caregiver more than the maximum concentration or amount of tetrahydrocannabinol permitted in a thirty – day period. The maximum concentration or amount of tetrahydrocannabinol permitted in a thirty – day period for a cannabinoid concentrate or medical cannabinoid product, or the cumulative total of both, is two thousand milligrams. Patients must have a specific certification from their physician in order to consume herbal cannabis formulations via combustion. Otherwise patients are permitted only to obtain cannabis infused tinctures, capsules, patches, or topical. Edible products are not defined as a “medical cannabinoid product” under the act. A health care provider may authorize the use of an enhanced amount (up to six ounces) of dried leaves or flowers of the plant of the genus cannabis in a combustible delivery form to treat or alleviate the patient’s debilitating medical condition of cancer.
  • Caregivers: all caregivers must submit the proper required documentation to the State Department of Health.

Sec. 1 Definitions—Hemp and THC

4.1 - 18.1 - 01. Hemp (Cannabis sativa l.).

"Hemp" means the plant Cannabis sativa l. and any part of the plant, including the seeds and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta - 9 tetrahydrocannabinol concentration of not more than three - tenths of one percent on a dry weight basis.

"Tetrahydrocannabinol" means delta-9 tetrahydrocannabinol and any structural, optical, or geometric isomers of tetrahydrocannabinol

"Total tetrahydrocannabinol" means the sum of the percentage, by weight, of tetrahydrocannabinolic acid multiplied by eight hundred seventy-seven thousandths plus the percentage of weight of tetrahydrocannabinol.

SEC. 3. AMENDMENT. Subsection 22 of section 19-24.1-01 of the North Dakota Century—Marijuana

Code is amended and reenacted as follows:

  1. "Marijuana" means all parts of the plant of the genus cannabis; the seeds of the plant; the resin extracted from any part of the plant; and every compound, manufacture, salt, derivative, mixture, or preparation of the plant, the seeds of the plant, or the resin extracted from any part of the plant. The term marijuana does not include hemp as defined in section 4.1 - 18.1 - 01.
