The 2018 Farm Bill
The 2018 Farm Bill authorized the widespread production of hemp derived products on a federal level, and removed hemp from the DEA (Drug Enforcement Administration) list of Controlled Substances.
This Bill differentiated industrial hemp from marijuana, which is cultivated for its high THC content. Federally legal hemp products, according to the Farm Bill, must contain less than 0.3% of THC by dry weight, and the source of THC must be industrial hemp.
Even though hemp is legal on a federal level, each state can determine which hemp-derived products are legal in said state. For example, Delta 8 gummies are legal on a federal level but illegal in a number of states.
The 2018 Farm Bill gives states the authority to submit plans to the United States Secretary of Agriculture in order to have primary regulatory control over the production of hemp within their borders. The plans must include procedures for tracking the land on which hemp will be grown, as well as testing, disposal, enforcement, inspection, and certification procedures.
Hawaii House Bill 2689
Soon after the US Federal government passed the Farm Bill in 2018, in 2020, Governor David Ige signed House Bill 2689 into law, which legally separated hemp and marijuana, and legalized certain types of hemp products. Legal THC products meet the same criteria specified by the federal Farm Bill.
The Law authorized the commercial cultivation and processing of hemp in Hawaii. The Law also required the Hawaii Department of Agriculture to license and regulate hemp in Hawaii.
Two crucial cannabis bills advanced in the Hawaiii Legislature in March 2021. Senate Bill 767 legalized cannabis and allowed licensed businesses to cultivate, produce, and sell cannabis products. The bill also allowed for the cultivation of up to three mature plants.
Senate Bill 758, increased decriminalized possession threshold from three grams to one ounce.
Medical Marijuana in Hawaii
The term “medical marijuana” refers to using the whole unprocessed marijuana plant or its basic extracts to treat a disease or symptom. Studies show that the marijuana plant contains chemicals that may help treat a range of illnesses or symptoms, and can assist patients suffering from serious medical conditions by alleviating pain and improving their quality of life.

In 2020, Hawaii became the first state to legalize medical marijuana legislatively, rather than through the ballot initiative process. Hawaiiian governor Ben Cayetano passed Act 228 into law in 2000, enabling medical marijuana cardholders to produce their own cannabis or choose a caregiver to do so.
According to Hawaii state regulations:
- Patients possession limits: Four ounces of usable marijuana at any given time jointly possessed between the qualifying patient and the primary caregiver. “Usable marijuana” does not include the seeds, stalks, and roots of the plant.
- Home cultivation is allowed to no more than seven marijuana plants, whether immature or mature.
- Qualifying for the medical marijuana program: To qualify for a medical card, a patient must have a qualifying condition and a statement from a Hawaiii physician or an advance practice registered nurse with prescribing authority that the “potential benefits of the medical use of marijuana would likely outweigh the health risks for the qualifying patient.”
The Hawaii Senate Health Committee adopted Senate Bill 2718 in March 2022 to modify the definition of "qualifying patient" in order to extend access to medicinal marijuana given its numerous advantages. The law made it simpler for senior citizens (those aged 65 and up) to have access to the state's current medicinal cannabis program.
Cannabis in Hawaii is illegal for recreational use, but decriminalized for possession of three grams or less.
Legalization of Hemp for Industrial Purposes
Sec. 1 Definitions—Industrial Hemp
- 141-A
"Industrial hemp" means the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3% on a dry weight basis.

(a) Only industrial hemp on the list of cultivars approved by the chairperson or board of agriculture shall be grown. Notwithstanding chapter 91, the chairperson or the board of agriculture may add or remove any cultivar from the list.
(b) The list of approved cultivars shall include the following:
(1) Industrial hemp cultivars that have been certified by the Organization for Economic Co-operation and Development;
(2) Hawaii varieties of industrial hemp cultivars that have been certified by the board of agriculture; and
(3) Hemp genetics that are shown to:
(A) Meet federal definitions of hemp;
(B) Originate from any state with a federally approved industrial hemp program; and
(C) Utilize testing and sampling protocols similar to those used in Hawaii's program or utilize a nationally standardized sampling and testing protocol.
What is Delta 9 THC?
