Following the federal legalization of hemp for industrial purposes, Minnesota followed up with similar state legislation authorizing the commercialization of Delta 9 THC products.The Minnesota House Bill 3595 was signed into law in 2019, which authorized the Minnesota Department of Agriculture to administer a state hemp program and accordingly legalize industrial hemp in consumer products, as well as its growing and production.
On July 1, 2022, a new law went into effect in Minnesota that provides new regulation for hemp products containing Delta 9 THC.
The bill, which was signed into law by Governor Tim Walz, allows for the sale of consumable products containing less than 5 milligrams of Delta 9 THC per serving and 50 milligrams per package. The products must be derived from hemp, which must contain less than 0.3% Delta 9 THC by dry weight under federal law.
The 2018 Farm Bill authorized the widespread production of hemp products on a federal level, and removed hemp from the DEA (Drug Enforcement Administration) list of Controlled Substances.
This Bill differentiated industrial hemp from marijuana, which is cultivated for its high THC content. Federally legal hemp products, according to the Farm Bill, must contain less than 0.3% of THC by dry weight, and the source of THC must be industrial hemp.
Even though hemp is legal on a federal level, each state can determine which hemp-derived products are legal in said state. For example, Delta 8 THC products are legal on a federal level but illegal in a number of states.
Soon after the US Federal government passed the Farm Bill, the 2021 Minnesota statute 151.52 addresses the legality of hemp products in Minnesota. According to this statute, Minnesota laws allow for the production, selling, and consumption of hemp products, so long as they contain less than 0.3% of THC by dry weight.
With the new Minnesota House Bill 3595, as of July 1, 2022, Minnesota residents who are at least 21 years old can purchase and consume edible and drinkable products containing hemp-derived THC that contain 3% or less by dry weight.
Food ingredients that will be combined with substances derived from hemp, to make an edible cannabinoid product, must meet requirements for food manufacturing. Prior to being combined with substances derived from hemp, food ingredients fall under the definition of “food” found in Minn. Stats. 34A.01, subd. 4, and are under the jurisdiction of the Minnesota Department of Agriculture.
Also important to mention is that Minn. Stats. 151.72 only allows for the sale of manufactured and packaged products that contain substances derived from hemp. It does not allow for food service or further food preparation activities using products which contain substances derived from hemp.
Minneapolis state also allows the prescribed use of marijuana for medical purposes. Medical marijuana can be used in all forms, including oral sprays, THC tinctures, capsules, etc. Note that medical marijuana is reserved for those who have a qualifying condition and have been approved for medical marijuana use.
In May 2014, Governor Mark Dayton signed into law a bill legalizing marijuana for the treatment of patients with severe medical conditions.
The Minnesota Medical Marijuana Act created a patient registry under the Department of Health relating to the therapeutic use of medical cannabis. It authorized the use of medical cannabis in limited forms for certain qualifying medical conditions and regulated the distribution and manufacture of medical cannabis.
Registration for the program began on June 1, 2015, with the actual distribution of medical marijuana beginning on July 1, 2015.

Notwithstanding any other section of this chapter, a product containing non intoxicating cannabinoids may be sold for human or animal consumption if all of the requirements of this section are met.
