Wyoming passed the House Bill 0171 in 2019, which authorized hemp production and hemp processing, and provided rulemaking authority to the Wyoming Department of Agriculture.
As a response to the 2018 Federal Farm Bill, which legalized hemp at the national level,
the WDA hemp plan was accepted by the USDA on February 20, 2020. The Governor, in consultation with the Wyoming Attorney General’s office, then approved emergency rules drafted by the WDA to initiate a hemp program providing new regulation for hemp products containing Delta 9 THC.
Under the 2018 Farm Bill, Delta 9 THC-containing products are legal on a federal level in the US, provided they meet the following conditions.
Wyoming followed up with similar state legislation authorizing the use of Delta 9 THC products that meet Farm Bill criteria.

The 2018 Farm Bill authorized the widespread production of hemp derived products on a federal level, and removed hemp from the DEA (Drug Enforcement Administration) list of Controlled Substances.
This Bill differentiated the definition of industrial hemp from marijuana, which is cultivated for its high THC content. Federally legal hemp products, according to the Farm Bill, must contain less than 0.3% of THC by dry weight, and the source of THC must be industrial hemp.
Even though hemp is legal on a federal level, each state can determine which hemp-derived products are legal in said state. For example, Delta 8 THC gummies are legal on a federal level but illegal in a number of states.
Current Wyoming state law only allows for the administration of medical cannabidiol containing less than 0.3 percent THC.
Soon after the US Federal government passed the Farm Bill, Governor Mark Gordon signed the House Bill 0171 in 2019, which legalized industrial hemp and hemp derivatives in Wyoming under the Farm Bill limits and specifications.
Hemp derived Delta 8 THC, CBD oils and CBG olis are legal in Wyoming as long as the THC content does not exceed 0.3% by dry weight.
CBD treatment is also legal in Wyoming, but it limits patients with intractable epilepsy to cannabidiol preparations with no more than 0.3 percent THC, in compliance with USDA hemp standards—but does not authorize in-state production in compliance with those rules.
The term “medical marijuana” refers to using the whole unprocessed marijuana plant or its basic extracts to treat a disease or symptom. Studies show that the marijuana plant contains chemicals that may help treat a range of illnesses or symptoms, and can assist patients suffering from serious medical conditions by alleviating pain and improving their quality of life.
While some states have already legalized marijuana for medicinal purposes, the issue is still being hotly debated in many others. In Wyoming, legislation is currently pending that would establish a regulatory framework for the retail sales and licensing of medical marijuana.
House Bill 143, known as the Wyoming Patient Cannabis Act of 2022, outlines more than sixteen qualifying conditions and symptoms for enrollment in the program. Patients would be able to possess up to four ounces of cannabis flower and up to twenty grams of product within a thirty-day period. They would also be able to home cultivate no more than eight mature marijuana plants.
Using recreational marijuana is strictly illegal in Wyoming. The state has some of the strictest cannabis laws in the US. Cannabis itself is not allowed for medical purposes, but a 2015 law allows limited use of non-psychoactive cannabidiol.
(iii) "Hemp" or "hemp product" means all parts, seeds and varieties of the plant cannabis Sativa l., whether growing or not, or a product, derivative, extract, cannabinoid, isomer, acid, salt or salt of isomer made from that plant with a THC concentration of not more than three‑tenths of one percent (0.3%) on a dry weight basis when using post‑decarboxylation or another similarly reliable testing method;
(v) "Produce" means all acts necessary to produce and market hemp including, without limitation, planting, cultivating, harvesting, cloning, producing seeds, handling, transporting, and selling;
(vi) "Process" means converting hemp into another product that contains no more than three‑tenths of one percent (0.3%) THC on a dry weight basis when using post‑decarboxylation or another similarly reliable testing method;
(vii) "THC" means tetrahydrocannabinol, the psychoactive component of the cannabis plant, with the scientific name trans‑delta 9‑tetrahydrocannabinol.
(d) If any substance is designated, rescheduled, or deleted as a controlled substance under federal law the commissioner shall control the substance under this act in the same manner as federal law within thirty (30) days after receiving notice of the change but not later than thirty (30) days after the first publication of the change in the Federal Register. Under this subsection, the commissioner shall control the substance in the same manner as federal law through the promulgation of an emergency rule, followed by promulgation of a permanent rule under the Wyoming Administrative Procedure Act. If the commissioner objects to the designation, rescheduling or deletion of a substance, the commissioner shall within the same period required to control the substance publish the reasons for objection and afford all interested parties an opportunity to be heard. At the conclusion of the hearing, the commissioner shall publish his decision which shall be final unless altered by statute. Upon publication of an objection to designation, rescheduling or deletion under this act by the commissioner, control under this act is stayed until the commissioner publishes his final decision. Any final decision that ultimately controls the substance under this act in the same manner as federal law shall be finalized through the promulgation of an emergency rule, followed by the promulgation of a permanent rule under the Wyoming Administrative Procedure Act.
(a) The provisions and penalties of this chapter shall not apply to:
(i) The possession or use of hemp or hemp products for any purpose or application;
(iii) Hemp production, processing or testing in accordance with the provisions of W.S. 11‑51‑101 through 11‑51‑107.
(b) As used in this section “hemp” or “hemp product” means all parts, seeds and varieties of the plant cannabis Sativa l. or a product made from that plant with a trans‑delta 9‑tetrahydrocannabinol (THC) concentration of not more than three‑tenths of one percent (0.3%) on a dry weight basis
