In July, 2019, Governor Chris Sununu signed House Bill 459-FN into law which legalized the growth, production, and transportation of industrial hemp in the state. The bill brought New Hampshire's hemp program in line with federal law as part of the 2018 Farm Bill.
HB 459-FN requires any grower, processor, or commercial trader of hemp to apply to the United States Department of Agriculture for a license. Licensed Hemp Growers may legally cultivate or grow hemp crops, whereas Licensed Hemp Processors/Handlers may receive and possess hemp harvests for the purpose of processing into "publicly marketable hemp products," such as seed oil or CBD oil.

Marijuana shall not include hemp grown, processed, marketed, or sold under RSA 439-A.
Amend 126-X:1, III to read as follows:
III. "Cannabis" means all parts of any plant of the Cannabis genus of plants, whether growing or not; the seeds thereof; the resin extracted from any part of such plant; and every compound, salt, derivative, mixture, or preparation of such plant, its seeds, or resin. Such term shall not include the mature stalks of such plants, fiber produced from such stalks, oil, or cake made from the seeds of such plants, any other compound, salt, derivative, mixture, or preparation of such mature stalks (except the resin extracted therefrom), fiber, oil or cake, or the sterilized seeds of such plants which are incapable of germination.
