Louisiana House Bill NO 491 was signed into law in 2019, which authorized the Louisiana Department of Agriculture and Forestry to administer a state hemp program and accordingly legalized industrial hemp growing and production.
Under the 2018 Farm Bill, products containing Delta 9 THC are legal on a federal level in the US, provided they meet the following conditions.
In accordance with the Agriculture Improvement Act of 2018, P.L. 115-334, Louisiana followed up with similar state legislation authorizing the use of Delta 9 THC products that meet Farm Bill criteria.

The 2018 Farm Bill authorized the widespread production of hemp derived products on a federal level, and removed hemp from the DEA (Drug Enforcement Administration) list of Controlled Substances.
This Bill differentiated industrial hemp from marijuana, which is cultivated for its high THC content. Federally legal hemp products, according to the Farm Bill, must contain less than 0.3% of THC by dry weight, and the source of THC must be industrial hemp.
Even though hemp is legal on a federal level, each state can determine which hemp-derived products are legal in said state. For example, Delta 8 THC gummies are legal on a federal level but illegal in a number of states.
The 2018 Farm Bill gives states the authority to submit plans to the United States Secretary of Agriculture in order to have primary regulatory control over the production of hemp within their borders. The plans must include procedures for tracking the land on which hemp will be grown, as well as testing, disposal, enforcement, inspection, and certification procedures.
Soon after the US Federal government passed the Farm Bill in 2018, in June 2019, Governor John Edwards signed House Bill 491 into law, which legally separated hemp and marijuana, and legalized certain types of hemp products. Legal THC products meet the same criteria specified by the federal Farm Bill.
The Law authorized the commercial cultivation and processing of hemp in Louisiana. The Law also required the Louisiana Department of Agriculture and Forestry to license and regulate hemp in Louisiana. The Louisiana Department of Agriculture and Forestry began the hemp licensing application process in early February 2020.
As a result of Act 336 of the 2021 Regular Legislative Session, the Louisiana Department of Agriculture and Forestry is no longer authorized to license or regulate processors of ‘consumable’ hemp as defined by R.S. 3:1481. As from 1 of August 2022, Louisiana Department of Health regulates the processing of any product derived from industrial hemp that contains any cannabinoid, including cannabidiol, and is intended for consumption or topical use.
Act. No. 336 (HB 640) eases restrictions on economic activity related to industrial hemp, reflecting states’ growing recognition of hemp as an economically useful agricultural product.
Act. No. 336 replaces “industrial hemp-derived CBD product” with “consumable hemp product,” and prohibits consumable hemp products from containing any cannabinoid not naturally occurring. Consumable hemp products include commercial feed, pet products, and floral hemp material. Floral hemp material will require packaging to be tamper-evident and not be labeled or marketed for inhalation. The Office of Alcohol and Tobacco Control is responsible for issuing wholesaler permits for consumable hemp products for a fee of up to $500, while also creating civil penalties for selling such products without a permit.
The term “medical marijuana” refers to using the whole unprocessed marijuana plant or its basic extracts to treat a disease or symptom. Studies show that the marijuana plant contains chemicals that may help treat a range of illnesses or symptoms, and can assist patients suffering from serious medical conditions by alleviating pain and improving their quality of life.
While some states have already legalized marijuana for medicinal purposes, the issue is still being hotly debated in many others. As of 2019, a total of 41 states in the US have successfully legislated medical marijuana programs, with 19 states adopting recreational cannabis programs, and 23 states decriminalizing cannabis entirely.
Louisiana has a medical marijuana program. Non-medical, adult use of cannabis is still illegal in Louisiana, however.
HB 819, signed by Governor John Edwards in 2020, greatly expanded access to medical cannabis. HB 819 allows any licensed doctor to recommend cannabis for any condition the doctor “considers debilitating to an individual patient and is qualified through his medical education and training to treat.”

It is hereby the intent of the legislature to recognize industrial hemp as an agricultural commodity and authorize the cultivation, processing, and transportation of industrial hemp as legal, agricultural activities in the state of Louisiana in accordance with the Agriculture Improvement Act of 2018, P.L. 115-334.
(10) "Industrial hemp" means the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol (THC) concentration of not more 0.3 percent on a dry weight basis.
(11) "Industrial hemp seed" means Cannabis sativa L. seed or other propagating stock which have been inspected and sampled during their period of growth and preparation for market by the commissioner, or by the inspection official of the state in which the seeds or propagating stock were grown, and which have been found to conform to the regulations issued by the commission pursuant to this Part.
(1) "CBD" means cannabidiol.
(4) "Industrial hemp" or "hemp" means the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol (THC) concentration of not more 0.3 percent on a dry weight basis.
(5) "Industrial hemp-derived CBD product" means any industrial hemp8 derived product or hemp-derived product that contains CBD intended for consumption or topical use.
