The national hemp law (“Farm Bill”) allows for the production of Delta 9 across the country, but each state can draft its own legislation that prohibits Delta 9 THC sales and consumption in said state.
As of 2022, Delta 9 is legal in 48 states. Idaho and Kansas don’t allow hemp products that contain any percentage of THC. The Kansas 2019 House Bill 2167 made THC products illegal in that state, while Idaho’s Uniform Controlled Substances Act made THC a controlled substance in the state of Idaho.
