Why Is Delta 9 Legal?

Though you can purchase and consume cannabis products in some states, federal law deems most cannabis products illegal across the US. So, how are some Delta 9 THC products legal?

The answer lies in just one document—The Agriculture Improvement Act of 2018. This legal document, better known as the Farm Bill, legalized industrial hemp production and made the consumption of hemp cannabinoids legal under certain conditions.

Is Delta 9 Legal Federally?

Yes, some types of Delta 9 are legal in the US on a federal level. The 2018 Farm Bill made the production, selling, and consumption of some hemp-derived THC products legal, including those with Delta-9, Delta-8, and Delta-10 THC.

For Delta 9 THC products to be compliant with the Farm Bill, they must follow two conditions:

1. The THC has to be extracted from the hemp plant, not marijuana

2. The product contains no more than 0.3% of Delta 9 THC by dry weight

Is Delta 9 Legal in All 50 States?

The national hemp law (“Farm Bill”) allows for the production of Delta 9 across the country, but each state can draft its own legislation that prohibits Delta 9 THC sales and consumption in said state.

As of 2022, Delta 9 is legal in 48 states. Idaho and Kansas don’t allow hemp products that contain any percentage of THC. The Kansas 2019 House Bill 2167 made THC products illegal in that state, while Idaho’s Uniform Controlled Substances Act made THC a controlled substance in the state of Idaho.

Unfortunately, we don’t ship THC products to these two states. We do, however, sell delicious broad-spectrum gummies with CBD, which don’t contain THC and are thus legal in Kansas and Idaho.

Is Delta 9 Good for You?

Yes, Delta 9 can be incredibly good for you, especially at low doses. Microdosing THC has been shown to have many benefits, as this compound appears to alleviate anxiety, reduce pain, and help you fall asleep easier.

These beneficial effects are even more pronounced if you take CBD and THC together. These two compounds produce an entourage effect, meaning that you get more benefits from each compound when you take them together.

Do Delta 9 Edibles Get You High?

Yes, Delta 9 edibles will get you high at a sufficient dosage. If you take a low dose of Delta 9, you will feel more relaxed, but you won’t experience the psychoactive effects of this compound. At higher doses, you will certainly feel high and experience psychoactive effects when taking hemp-derived Delta-9 THC edibles.

How Many Mg of Delta 9 Does it Take to Get High?

The exact dosage of Delta 9 that will get you high depends on your experience with this compound. When it comes to hemp-derived THC gummies, for most recreational users a dosage of around 10 mg is enough to get high.

Taking Delta-9 gummies safely is paramount, especially if you’re new to edibles. We recommend starting with a low dosage (2-5 mg) and working your way up once you get used to the effects of THC.

What Does a Delta 9 High Feel Like?

The type of Delta 9 high you will experience depends on how used you are to the effects of this compound and how much Delta 9 THC you take. At low doses, THC will help you fall asleep, alleviate pain, and relax you, but won’t get you high.

At a higher dosage, you can expect psychoactive effects such as*:

  • appetite increase
  • changes in perception (at particularly high doses)

FAQ on Delta 9 Gummies Legality

What should I look for in hemp-derived Delta 9 gummies?

With the recent hemp industry boom, it’s easy to find hemp-derived Delta 9 gummies. However, finding high-quality hemp products is not as simple.

When purchasing legal, hemp Delta-9 products, such as Delta 9 gummies, you should shop from companies that do lab testing for product safety and potency in third-party labs.

nama CBD tests each batch in a third-party lab, with lab reports and the certificate of analysis for each product available on our website.

Do Delta 9 gummies show up on a drug test?

Yes, Delta 9 gummies do show up on drug tests. Even hemp-derived products with Delta 9 will show up on drug tests that test for THC and other cannabinoids. Therefore, if you know you’re getting tested soon, refrain from taking Delta 9 products for about a month beforehand.

Does Delta 9 get you higher than Delta-8 THC?

Yes, Delta 9 will get you higher than Delta 8 THC. Generally, Delta-8 products have milder effects than Delta 9 products, which is why it's a good idea to start with Delta 8 if you’re new to THC. If you’re interested in trying a hemp-derived Delta-8 product, check out our delicious Elevate Delta 8 gummies.

Is Delta 9 a psychedelic?

Delta 9 is not psychedelic, but it can have psychedelic-like effects (hallucinations and paranoia) when taken in high doses. If you don’t want to experience the psychedelic effects of Delta 9, stick to lower doses. At low doses, THC will provide an abundance of benefits without getting you high.

Do CBD oils contain Delta-9 THC?

Some CBD oils contain Delta 9 THC, while others do not. If you’re taking CBD for pain, anxiety, and sleep issues, it’s best to go with hemp derived full-spectrum CBD gummies, which also contain THC.

Many nama CBD products contain both CBD and Delta 9 THC. For instance, when shopping for sleep gummies on our website, you can choose from ones with CBD, THC, and melatonin, and ones that only contain CBD and melatonin.
